Terms & Conditions — Volio App

These Terms & Conditions govern your use of Volio App. By creating an account and using the App, you confirm that you have read, understood, and agree to these Terms. If you are participating in the Beta Testing Program, additional conditions in Section 10 also apply to you.

1. Introduction

These Terms & Conditions ("Terms") govern your use of Volio App (the "App"), a mobile application that allows users to share their flight tracks. Using the FlightAware AeroAPI service, the App sources real-time or recorded aircraft transponder (ADS-B) data and associates it with your user profile as you choose to implement it. Maps within the App are rendered using the Mapbox mapping platform.

The App is currently in its early release stage and has not yet been incorporated as a formal legal entity. By creating an account, you are entering into an agreement with Issak Zanini, the individual developer and owner of Volio App, resident in the Province of Como, Italy. Once a legal entity is formally registered, this agreement will be automatically transferred to and assumed by that entity, and you will be notified accordingly.

2. Eligibility

The App is available to individuals who are at least 18 years of age. By creating an account, you confirm that you meet this requirement. Issak Zanini reserves the right to verify eligibility and to refuse or revoke access at any time.

3. Early Release — App Status

Volio App is currently in an early release stage. This means:

The App may contain bugs, errors, or incomplete features.
Features may change, be added, removed, or interrupted without prior notice.
Data stored in the App may occasionally be lost during updates or resets.
Availability of the App is not guaranteed and may be suspended at any time.

Use of the App in its current form is free of charge. The App's infrastructure is hosted on Amazon Web Services (AWS), EU region eu-south-1 (Milan, Italy), ensuring all user data remains within the European Union.

4. ADS-B Data, Flight Track Sharing and User Responsibilities

The App uses FlightAware's AeroAPI service to source aircraft transponder (ADS-B) data covering aircraft, helicopters, gliders, ultralights, and other flying objects capable of generating ADS-B or equivalent transponder signals. ADS-B data is the exclusive property of FlightAware LLC and its licensors. Maps are rendered via the Mapbox platform; by using the App you agree that map tile requests are processed by Mapbox in accordance with their Privacy Policy.

By using the flight tracking feature, you explicitly acknowledge and agree to the following:

The App sources ADS-B data via FlightAware AeroAPI and associates it with your user profile as you choose to implement it.
Your flight track data, once associated with your profile, will be visible to and shared with other registered users of the App.
ADS-B data displayed in the App may be subject to geographical and technical coverage limitations. It may be inaccurate, incomplete, or delayed.
Issak Zanini is not responsible for the accuracy, completeness, or availability of data sourced from FlightAware.
The data must not be used for safety-of-life activities, real-time navigation, collision avoidance, air traffic control, or any safety-critical aviation purpose.

User Representation — Authority to Associate Flight Data

Important: By associating any flight track or ADS-B data with your profile, you represent and warrant that you are the pilot, operator, or owner of the relevant aircraft, helicopter, glider, ultralight, or other flying object — OR that you have obtained the explicit prior consent of the pilot or operator to associate their flight data with your profile and share it within the App. Associating flight data for a flying object you did not pilot and for which you do not have the operator's consent constitutes a breach of these Terms and may constitute a violation of applicable privacy law.

5. Wrongful Association — Disputes and Takedown

If you believe that a flight track or ADS-B data relating to an aircraft, helicopter, glider, ultralight, or other flying object you piloted or operate has been wrongly associated with another user's profile without your consent, you have the right to request its immediate removal by contacting us at admin@volioapp.it.

We will review and action all such requests within 72 hours of receipt. This right exists independently of and in addition to any rights you may have under applicable data protection law, including the right to erasure under the GDPR.

Where a takedown request is upheld, we reserve the right to suspend or permanently revoke the account of the user responsible for the wrongful association.

6. Indemnification

You agree to defend, indemnify, and hold harmless Issak Zanini (and any future legal entity assuming this agreement), its officers, agents, and successors, from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your breach of the representation in Section 4 regarding your authority to associate flight data with your profile;
Any claim by a third party — including another pilot, aircraft operator, or owner of a flying object — that you have wrongfully associated their flight data with your profile without consent;
Any violation of a third party's privacy rights, publicity rights, or data protection rights arising from your use of the App's flight tracking features;
Any use of the App that violates applicable law, including aviation regulations in your country of residence.

Issak Zanini is not liable for any wrongful association of flight data carried out by users in breach of these Terms. By accepting these Terms, you acknowledge that you are solely responsible for ensuring you have the right to use and share any flight data you associate with your profile.

7. Intellectual Property

All intellectual property rights in the App — including its design, code, name, and functionality — remain exclusively with Issak Zanini (and the future registered company). ADS-B data sourced via FlightAware AeroAPI remains the exclusive property of FlightAware LLC and its licensors. Map imagery and data rendered via Mapbox remains the property of Mapbox Inc. and its data providers.

You may not reproduce, distribute, modify, or create derivative works of any part of the App without prior written consent.

8. Prohibited Use

You agree to use the App only for its intended purpose and in compliance with applicable law, including aviation regulations in your country of residence. You must not:

Associate ADS-B or flight track data with aircraft or flying objects you are not authorised to represent.
Use flight data displayed in the App for safety-critical aviation decisions, navigation, or air traffic control purposes.
Attempt to reverse-engineer, decompile, or extract the App's source code, the underlying FlightAware data feed, or Mapbox map data.
Interfere with or disrupt the App's infrastructure or other users' access.
Share your account credentials with third parties.
Use the App for any unlawful purpose.

9. Disclaimer of Warranties and Limitation of Liability

The App is provided "as is" and "as available", without any warranties of any kind, whether express or implied. As an early release product, the App is inherently subject to instability. Flight track data sourced via FlightAware AeroAPI and map data via Mapbox are provided by third parties without warranty as to accuracy, quality, or completeness. Do not rely on any data in this App for safety-critical or navigation purposes.

To the maximum extent permitted by applicable law, Issak Zanini shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including any reliance on ADS-B or map data. Total liability, if any, shall not exceed €100.

Nothing in these Terms limits liability for death, personal injury, or fraud caused by gross negligence or wilful misconduct.

Beta Testing Program

10. Additional Conditions for Beta Testers

This section applies exclusively to users who have been invited to participate in the Volio App Beta Testing Program. Recruitment takes place via LinkedIn, Instagram, other social platforms, or personal invitation. Beta tester signup is conducted through a dedicated Microsoft Form, where consent to these additional conditions is recorded. If you have not been specifically invited and have not completed the beta signup form, this section does not apply to you.

10.1 Recruitment and Signup

Prospective beta testers are recruited by Issak Zanini through LinkedIn, Instagram, other social media platforms, or in person. Upon expressing interest, candidates are directed to a dedicated Microsoft Forms signup form, through which the following information is collected:

Full name
Email address
Phone number (optional — only if the candidate consents to being contacted via WhatsApp for beta coordination)

The Microsoft Forms signup form includes mandatory consent checkboxes for: (a) acceptance of these Terms & Conditions; (b) acceptance of the Privacy Policy; and (c) optionally, consent to WhatsApp contact where a phone number is provided. Submission of the form constitutes the moment of formal consent and creates a timestamped record stored in Issak Zanini's Microsoft account.

10.2 WhatsApp Contact (Optional)

Beta testers who optionally provide their phone number consent to being added to a private WhatsApp group used exclusively for beta coordination — including announcements, issue reporting, and direct support. Participation in the WhatsApp group is entirely voluntary. Testers may leave the group at any time and may request deletion of their phone number by contacting admin@volioapp.it.

10.3 Nature of Beta Testing

As a beta tester, you are invited to use the App in an active testing capacity and to provide structured feedback to help improve the product ahead of a wider release. Beta testing participation is voluntary, unpaid, and may be revoked at any time.

10.4 Confidentiality

Beta testers agree to keep all aspects of the beta experience strictly confidential. You must not:

Publicly disclose, publish, or share screenshots, recordings, or descriptions of App features — including on social media, forums, blogs, or review platforms — without prior written consent from Issak Zanini.
Discuss unreleased features, UI changes, or functionality with individuals outside the beta program.
Share your beta access credentials or invite others to access the beta build.

This confidentiality obligation survives the end of your beta testing participation.

10.5 Feedback and Intellectual Property

You may be asked to provide feedback, bug reports, suggestions, or ideas ("Feedback") during the beta program. By submitting Feedback, you grant Issak Zanini (and any future entity assuming this agreement) a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and develop that Feedback without any obligation or compensation to you. You acknowledge that all Feedback becomes the sole property of Issak Zanini.

10.6 Data During Beta Testing

Data generated during beta testing — including flight tracks, interactions, and usage patterns — may be used specifically for product development, debugging, and improvement purposes in addition to the general uses described in Section 3. Beta test data may be retained beyond standard retention periods in anonymised form for analytical purposes.

10.7 Termination of Beta Access

Issak Zanini may terminate beta testing access at any time and for any reason, including but not limited to: breach of confidentiality obligations, misuse of the beta build, or conclusion of the beta program. Upon termination, the confidentiality obligations in Section 10.4 and the IP assignment in Section 10.5 continue to apply.

11. Future Communications

By creating an account, you agree that your email address may be used to contact you regarding:

Important updates or changes to the App or these Terms.
New features, releases, or announcements related to Volio App.

Email communications are managed via Brevo, an EU-based platform (France). You may opt out at any time by contacting admin@volioapp.it or using the unsubscribe link in any email.

12. Transfer to Future Entity

You expressly acknowledge and agree that once Volio App is incorporated as a legal entity, all rights and obligations under these Terms will be transferred to that entity. You will be informed of the entity's name and registration details at that time.

13. Governing Law and Disputes

These Terms are governed by Italian law. For users residing in Switzerland, mandatory Swiss consumer protection provisions also apply. For all users in the European Union, mandatory consumer protection rules of your country of residence are not overridden by this clause.

Any dispute that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Como, Italy, without prejudice to EU and Swiss residents' rights to bring proceedings before their local courts.

14. Changes to These Terms

Issak Zanini reserves the right to update these Terms at any time. You will be notified by email at least 14 days before material changes take effect. Continued use of the App after that date constitutes acceptance of the revised Terms.
